STATEMENT OF THE CASE

Defendant-appellee, Michael McGraw (McGraw) was charged and convicted by a jury in Marion Superior Court, Criminal Division, Room One, of two counts of theft of "the use of computer services". After the return of the jury verdicts, but before sentencing, the trial court sustained McGraw's new and refiled motion to dismiss the two charges because the information failed to state an offense...
