This action has its origins in a February, 1979 calling, as a result of plaintiffs' alleged kiting of checks, of certain loans made by the defendant banks to plaintiffs. Defendant Berenthal apparently represented plaintiffs in, inter alia, obtaining these loans. After two weeks of negotiations, at which all parties were represented by counsel, a settlement with respect to the loans was reached, pursuant to which confessions of judgment were executed and mutual releases...
