This case is before this court for the second time. This second appeal is from the judgment of the District Court of Crow Wing County, which dismissed a declaratory judgment action brought by appellant seeking to void a special assessment made by respondents. The trial court held that, although notice of the assessment hearing was statutorily and constitutionally deficient, the appellant had waived his right to set aside the assessment...
