The defendant appeals from his conviction on an indictment charging him with assault and battery by means of a dangerous weapon. Verdicts of not guilty were returned on indictments arising out of the same incident and charging him with assault with intent to murder and armed robbery. The sole question on appeal is whether the trial judge erred in refusing to instruct the jury on the question of self-defense. We reverse.
