This cause came on to be heard upon an appeal from the Court of Common Pleas of Butler County.

On August 21, 1979, plaintiffappellee, Otis Kimbrell, filed a petition with the Butler County Board of Elections to become a write-in candidate for the office of Clerk-treasurer of the village of Seven Mile, Ohio. Kimbrell was unopposed and was elected to a four-year term as clerk-treasurer in November 1979.
