Upon consideration of the defendant's petition filed in this matter for discretionary review of the decision of the North Carolina Court of Appeals pursuant to G.S. § 7A-31, the following order was entered and is hereby certified to the North Carolina Court of Appeals:

"The petition is allowed. New Briefs shall be filed pursuant to Appellate Rule 15(g); and the case shall be submitted on those briefs alone, without oral argument, pursuant to Appellate Rule 30...
