The first issue in this case is whether defendant's trial counsel ineffectively represented the defendant by failing to file a notice of alibi pursuant to sec. 971.23 (8), Stats.1

The second issue is whether a criminally charged defendant, failing to file a notice of alibi pursuant to statute, has the constitutional right under the United States or Wisconsin Constitutions...
