The facts giving rise to this action are that defendant, an attorney licensed in North Carolina, represented plaintiff in a personal injury action to recover damages for injuries plaintiff sustained in an automobile collision. The action proceeded to trial, and directed verdict was entered against plaintiff. Plaintiff then obtained additional counsel and filed a motion to vacate the judgment and award a new trial.
