The Commissioner of Labor of the State of Georgia, filed a complaint in Bibb Superior Court. He named the five members of the State Campaign and Financial Disclosure Commission as defendants. He alleged in a number of particulars that the defendants had acted in excess of their statutory authority during an investigation of his election campaign, and that the Act creating the Commission was unconstitutional in part.
