This cause came on to be heard upon an appeal from the Court of Common Pleas of Preble County.

On May 27, 1983, a complaint was filed in the Juvenile Division of the Court of Common Pleas of Preble County alleging that appellant, Kenny Burgess, was a delinquent child.
