The defendant, Robert Kunze, pleaded guilty in the state district court to two counts of theft of property and was sentenced to five years in the North Dakota state penitentiary to commence at twelve o'clock noon on the 15th day of September, 1982 on count 1; and on count 2 to a five years' suspended sentence.
