The jury convicted the defendant of the possession of marijuana with intent to sell and the manufacture of marijuana. Prior to trial before Judge Herring, the defendant had made a motion before Judge Friday to suppress the marijuana evidence on the grounds that it was obtained from within the defendant's curtilage without either a search warrant or circumstances justifying an exception to the warrant requirement.
