Plaintiff appeals as of right from the trial court's opinion and order granting defendant's motion for summary judgment pursuant to GCR 1963, 117.2(1).

Plaintiff was allegedly injured when his vehicle hit a patch of ice and snow on US-31. Plaintiff claims the ice and snow were on the road because defendant, in snowplowing an overpass called Airline Highway, plowed the snow and ice onto US-31.
