On October 24, 1978 Carol Mummery was struck and killed by a motor vehicle as she was walking to a school bus stop. The vehicle was operated by Radcliffe W. Farley and owned by North American Clothing Card Co., Inc. (Farley). Plaintiff, administrator of his daughter's estate, started an action in trespass1 against Farley and the North Penn School District
