Jerry Lee Pennington was convicted in the Circuit Court for Harford County of attempted breaking with intent to steal $300 or more, malicious destruction of property, and being a rogue and vagabond. The Court of Special Appeals reversed the attempted breaking conviction and remanded for a new trial consistent with its opinion; the intermediate appellate court upheld the other two convictions.
