BATCHELDER, J.

The defendant was charged with misdemeanor theft. See RSA 637:3, I; RSA 637:11, III (Supp. 1983). After a jury trial in Superior Court (Dunn, J.), the defendant was convicted and sentenced to nine months in the house of correction. During the State's case, the defendant moved for a mistrial. The court denied the defendant's motion, subject to exception, and the defendant appealed from the denial of his motion. For the reasons which follow...
