This is an appeal by defendant, Kenneth W. Whitmeyer, from a judgment of conviction and sentence entered by the Court of Common Pleas of Crawford County.

The indictment stated that defendant "did cause or attempt to cause physical harm to James T. Johnson by means of a deadly weapon, to-wit: a piece of asphalt thrown from an over-head bridge, a Felony of the Second Degree, in violation of Section 2903. 11(A)(2) of the Revised Code of Ohio."
