ADRINE, J.
This matter came on for trial on October 15, 1984. A jury, which had previously been requested, was waived. Testimony was taken relative to the plaintiff's complaint and the defendant's answer thereto, as well as relative to the defendant's counterclaim and plaintiff's response thereto. Following the hearing, the court took the matter under advisement and now issues its findings of fact and conclusions of law and renders judgment accordingly.
