Petitioner-defendant, Kenneth Kushlan, was charged with resisting arrest, assault and aggravated disorderly conduct under state law. Briefly, Eastlake police officers were in the process of serving a felony arrest warrant for an escape from their city jail where defendant had been sentenced.
