In response to plaintiff's third amended complaint, accepted and filed by the court in a September 13, 1984 order, defendant Kovac's, Inc. has moved to have United Food and Commercial Workers Union, Local 576 (hereinafter Union) added as a necessary party (Fed.R.Civ.P. 19(a)) or, in the alternative, for leave to file a third party complaint against the Union (Fed.R.Civ.P. 14(a)).
