Following a jury trial, a verdict was returned in favor of defendants, James R. Blanning, Jr., Park Tunnel Mining & Milling Company (Park Tunnel), and Aspen Western Corporation, against plaintiff, Maco Stewart, on his claim of fraud in the inducement of an agreement. On appeal, Stewart claims that the trial court erred by requiring him to elect to pursue the same remedy with respect to two agreements executed contemporaneously. We affirm in part...
