This action arose out of a labor dispute surrounding the sale of warehouse facilities by Kroger to Hamady. The plaintiffs, former Kroger employees who were not hired by Hamady after the sale, brought the action alleging, inter alia, that the union breached its duty of fair representation to the plaintiffs in not protecting their seniority and other rights under the collective bargaining agreement with Kroger...
