OPINION

SINGLETON, Judge.

Peter G. Burnett pled no contest to a charge of refusing a breathalyzer test. AMC 9.28.022(C). With the approval of the court and the prosecutor he reserved the right to appeal the rejection of his constitutional challenges to the ordinance. We therefore have jurisdiction of this appeal.
