On June 11, 1981, plaintiffs-appellants Charles Rice, Wanda Kirschner and Allstate Insurance Company (Rice's insurer) filed a complaint in the Court of Common Pleas of Brown County, naming as defendants Mabel Fay Jodrey and Auto-Owners Insurance Company ("Auto-Owners").
