The plaintiff, Ben Zavorka, a head brakeman for defendant, Union Pacific Railroad, suffered injuries when the train he was riding in collided with another train between Rawlins and Cheyenne, Wyoming. Zavorka sued the railroad for negligence under the Federal Employers' Liability Act, 45 U.S.C.A. § 51 et seq. (1970).
