When the trial court reached this employment discrimination case, the plaintiff's lawyer simply refused to start the trial. The court ordered the plaintiff to reimburse the defendant those fees and expenses incurred in preparation for the scheduled trial that had been, in effect, wasted as a result of the necessity for rescheduling the trial.
