The question on this appeal is whether the trial court erred in issuing a writ of mandamus to compel the defendant members of the Cheshire town council1 to submit an ordinance proposed by initiative petition to referendum. Because the trial court refused to consider whether the proposed ordinance clearly exceeded the power of the electorate, we find error and remand for a new trial.
