This matter comes before the Court on the motion of the defendant, Roger P. Guissinger, as Secretary of the Louisiana Department of Health and Human Resources, to dismiss the plaintiff's claims for want of jurisdiction over the subject matter and for failure to state a claim upon which relief may be granted.
