PADGETT, Justice.

This is an appeal from a summary judgment granted to defendants-appellees John Rapp and Goodsill Anderson & Quinn, in an action against them and Ronald B. Cohen and Patrick J. Ryan for malicious prosecution and abuse of process in a preceding civil action and bankruptcy. The judgment below contained the necessary recitals under Rule 54(b), HRCP, to make it final. The Intermediate Court of Appeals affirmed the summary judgment,
