Dames appealed to the Land Use Board of Appeals (LUBA) from the city's decision to enter into a contract for the widening of a street. Pursuant to ORS 197.845, LUBA ordered the street-widening project stayed while the appeal was pending and required Dames to post a $5,000 bond.
