686 P.2d 1043 (1984)

69 Or.App. 562

STATE of Oregon ex rel. Adult and Family Services Division, Appellant, v. Gary Martin CARLSON, Respondent.

Court of Appeals of Oregon.

Decided August 29, 1984.

Reconsideration Denied October 19, 1984.

Attorney(s) appearing for the Case

Christine Chute, Asst. Atty. Gen., Salem, argued the cause, for appellant. With her on the brief were Dave Frohnmayer, Atty. Gen., and James E. Mountain, Jr., Sol. Gen., Salem.

Daniel Hoarfrost, Portland, argued the cause, for respondent. On the brief were Donald D. Nash and Nash & Hoarfrost, Portland.

Before GILLETTE, P.J., JOSEPH, C.J., and YOUNG, J.

PER CURIAM.

In this filiation proceeding, the state appeals from a jury verdict in favor of defendant putative father. We agree that one of its assignments of error is well taken: the trial court erred in refusing to admit certain blood test results concerning defendant. The error was not harmless.
