DITTER, District Judge.

John C. Strelecki, Jr., was a mildly retarded individual who was involuntarily committed to Embreeville State Hospital on March 17, 1980, pursuant to an order of the Montgomery County Court of Common Pleas. On April 3, 1980, Strelecki choked on his food while eating lunch and died shortly thereafter due to asphyxiation.
