On July 15, 1980, plaintiffs filed suit to collect on an unsecured note executed by defendant in the principal amount of $13,500. At the hearing on a motion for summary judgment filed by the plaintiffs, defendant moved to amend his answer in order to assert a previously omitted counterclaim alleging unjust enrichment.
