On October 28, 1982, the appellant Kenny Casimier was indicted for aggravated rape in violation of R.S. 14:42. He was arraigned on November 12th and pled not guilty. On March 3, 1983, a twelve member jury found him guilty of sexual battery in violation of R.S. 14:43.1.1 A pre-sentence investigation was ordered at that time.
