Applicant, Roswell C. Downer, was charged with first-offense DWI, a violation of LSA-R.S. 14:98. The alleged offense took place on June 16, 1984. Before trial, applicant moved to suppress the results of a photoelectric intoximeter (PEI) test. When the district judge denied this motion, applicant changed his plea to guilty, reserving his right of appellate review under State v. Crosby, 338 So.2d 584 (La.1976...
