This is an appeal from a take-nothing summary judgment rendered in favor of appellees (hereinafter referred to as the Fabelas) against appellants (hereinafter referred to as the Garcia). The Garcias brought suit to impress an equitable trust upon their home, and alternatively for damages, based upon the Fabelas' refusal to reconvey the real property under an oral agreement.
