This is an appeal from a summary judgment. Plaintiffs are the children of Federico Cuevas and Maria Guadalupe Cuevas, deceased. Maria Guadalupe died intestate on December 17, 1980. The principal asset of her estate was the community property homestead. Subsequent to her death, Federico remarried and sold this homestead in Alice and purchased a residence in Corpus Christi.
