The appellee/cross-appellant, Malcolm Scott Riley (defendant), was convicted after a jury trial of the crime of sale of marijuana, a class 2 felony, in violation of A.R.S. § 13-3405. After trial, he admitted the allegation of a prior felony conviction, which subjected him to the enhanced punishment provisions of A.R.S. § 13-604(B). As a repeat offender who stood convicted of a class 2 felony, he was subject to a sentencing range...
