BERMAN, Judge.

Defendant, Jesus Barrientos Garcia, appeals his conviction by a jury of the first degree murder of Herman Maestas. We affirm.

On April 8, 1981, Herman Maestas failed to attend work and a phone call to his apartment was unanswered. On April 9, 1981, Maestas' body was discovered in his apartment. A pathologist later testified that Maestas had been dead two or three days before the body was discovered. Part of a towel was protruding from the victim...
