The non-resident defendant in a negligence action appeals from the trial court's order denying his motion to quash service of process. We have jurisdiction. Fla.R. App.P. 9.030(b)(1)(B) and 9.130(a)(3)(C)(i).

An automobile accident occurred in 1976. Appellee attempted to secure substituted service upon appellant by serving process upon the Secretary of State in 1980. Appellee failed to file an affidavit of compliance as required by section 48...
