KENNEDY, Justice.

Appellant was convicted in the justice court of the offense of "unlawfully passing school bus while loading," under TEX. REV.CIV.STAT.ANN. art. 6701d sec. 104(a) (Vernon 1977), and was assessed a fine of $25.00, plus $6.00 costs. This conviction was appealed, and a trial de novo was granted in the county court.
