Appellant was convicted in a court-tried case of cultivating marijuana in violation of § 195.020 RSMo 1978 and sentenced to a year and a day in the Missouri Department of Corrections. Appellant claims on appeal that because the placement of marijuana under Schedule I Controlled Substance was without a rational basis, the trial court erred in overruling his motion to dismiss and in convicting him in violation of his constitutional rights to due process...
