STATE v. DAISE

No. 83-2253.

451 So.2d 1032 (1984)

The STATE of Florida, Appellant, v. Alfred DAISE, Appellee.

District Court of Appeal of Florida, Third District.

June 26, 1984.

Attorney(s) appearing for the Case

Jim Smith, Atty. Gen. and Diane Leeds, Asst. Atty. Gen., for appellant.

Joe Lang Kershaw, Jr., Miami, for appellee.

Before BARKDULL, BASKIN and FERGUSON, JJ.

PER CURIAM.

The state appeals the trial court's order granting defendant Daise a mistrial and a new trial. We affirm upon a finding that the record fails to disclose any clear abuse of discretion by the trial court. See State v. Woodson, 330 So.2d 152 (Fla. 4th DCA 1976); Jones v. State, 233 So.2d 432 (Fla. 3d DCA 1970); Hanson v. State, 187 So.2d 54
