UTTER, Justice.

Following remand of this case from the Texas Court of Criminal Appeals, we reform and, as reformed, affirm the judgment of the trial court.

Appellant was initially adjudged guilty of the offense of burglary of a building on September 18, 1980, in Cause Number CR-622-80-B in the 93rd District Court of Hidalgo County, Texas, and was assessed punishment at three years in the Texas Department of Corrections and a $750.00 fine...
