On October 1, 1984, pursuant to subpoena, appellant appeared before the President's Commission on Organized Crime (Commission), but asserted his fifth amendment privilege in response to a number of questions. On October 19, 1984, he was granted immunity pursuant to 18 U.S.C. § 6004, but he still refused to answer, whereupon an ex parte order was obtained that day from a district court ordering appellant to testify.
