Appellant, Liberty Enterprises, Inc. ("Liberty"), a Kansas corporation, was sued by appellee, Moore Transportation Company, Inc. ("Moore") for freight charges on shipments of oilfield tubular goods which Liberty had purchased from appellee Fort Worth Pipe Company ("Fort Worth Pipe").
