Jerry Lee Jones was indicted for the capital offense of robbery wherein the victim is intentionally killed. Alabama Code § 13-11-2(a)(2) (1975). The jury found him guilty of the lesser included offense of murder in the first degree and fixed his punishment at life imprisonment.
