Defendant and his accomplice were arrested on October 21, 1981 for selling heroin. Arraigned the next day, they were indicted on December 3 of that year on two counts of criminal possession of a controlled substance, third degree, and one count each of criminal possession of a controlled substance in the fourth and seventh degrees.
