The remaining defendants, CMI Corporation ("CMI"), CMI Financial Services, Inc. ("CMIFS"), and Edward Cherney, have moved for summary judgment or to dismiss. The Torchmark defendants have heretofore been dismissed for lack of personal jurisdiction.
