Frank and Marilyn Heger (plaintiff) sued G. "Jim" and Veva Hasslocher (defendant) for breach of contract, specific performance, and attorney's fees pursuant to TEX. REV.CIV.STAT.ANN. art. 2226 (Vernon Supp.1982-1983). Alternatively plaintiff sued for a declaratory judgment finding a joint venture. Known as the North Star diamond, the subject of the suit is a "blue" diamond of about 32.40 carats. Suit was tried to a jury solely on the joint venture...
